The difference in trademark filing official fees will be a significant 30%, rising from 347.35 CAD to 458 CAD. It is important to note that these costs will still be subject to annual adjustments based on inflation, as per the Service Fees Act, starting from the 2024 calendar year.
The CIPO has stated that these fee adjustments are necessary to account for the growing costs of providing services, fulfilling trade and treaty obligations and addressing technological shortcomings. These modifications also aim to align the CIPO's services with those offered by international counterparts.
Considering the upcoming fee rises, we strongly advise entities with Intellectual Property portfolios in Canada to take advantage of the lower rates before January 1, 2024. This is particularly relevant for entities intending to file trademark applications covering multiple classes or seeking to renew multi-class registrations.
