Session 4:

Generative AI as creators –
Patent ownership and copyright boundaries are being reshaped

What we  talked about

In a world where only humans were once thought to hold the keys to creativity, generative AI is now taking center stage, reshaping how we think about who or what can be an artist.

From penning novels and poems to painting canvases and composing melodies, AI is pushing the boundaries of what we thought possible.

As we marvel at these advancements, an even more thrilling topic arises: The intricate dance between Generative AI and Patent Law.

How do the laws conceived for human invention grapple with the wonders birthed by algorithms? As AI continues its rapid and profound evolution, we are left grappling with thought-provoking dilemmas: Who truly owns the data that sparks these breathtaking AI creations? And once they come to life, forming pieces of art or groundbreaking innovations, to whom do the rights rightfully belong?

Join us in this eye-opening seminar as we dive into the heart of modern copyright debates, and we explore the future of ownership.

Agenda

  • What are Generative AI and Inventive AI? Examples and recent developments. Presented by Anna Chiettini
In this section, we're looking to drill down into the essence and nuances of both Generative and Inventive AI. The aim is to provide a clear understanding, supplemented by compelling examples and highlighting recent advancements. The goal is to offer attendees a comprehensive overview and to set the stage for subsequent discussions.
  • The copyright perspective. Presented by Richard Brunner
Here, we transition into the realm of copyright. The focus should be on how generative creations intersect with existing copyright frameworks. It's essential to address challenges, precedents, and potential future trajectories.
  • The patent law perspective. Presented by Malte Köllner
The final segment revolves around the intricacies of patent law in the context of AI-generated inventions. The idea is to dissect how current patent systems are equipped (or not) to handle AI innovations. Delve into dilemmas faced by legal experts, and projections on how patent law might evolve to encompass the rapid developments in AI.
